1. Agreement to Terms

By accessing or using the emHealth application and website, you agree to be bound by these Terms and Conditions.

These Terms apply to all visitors, users, and others who access or use the service.

2. User License

Permission is granted to temporarily download one copy of the materials on emHealth's website for personal, non-commercial transitory viewing only. This is the grant of a limited user license, not a transfer of title, and under this license you may not:

• Modify or copy the materials

• Use the materials for any commercial purpose or for any public display

• Attempt to reverse engineer any software contained on the website

• Remove any copyright or other proprietary notations from the materials

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

emHealth provides a platform for booking diagnostic tests and health packages. We do not provide medical advice, diagnosis, or treatment. The information provided on our platform is for informational purposes only and should not be considered as medical advice.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on our platform.

5. Booking and Payment Terms

5.1 Booking Confirmation

All bookings are subject to confirmation by the service provider. We reserve the right to cancel or modify any booking at our discretion.

5.2 Payment

Payment must be made at the time of booking unless otherwise specified. We accept various payment methods including credit cards, debit cards, and digital wallets. All prices are in Indian Rupees (INR) unless otherwise stated.

5.3 Cancellation and Refunds

Cancellation policies vary by service provider. Refunds, if applicable, will be processed according to our refund policy. Cancellation requests must be made at least 24 hours before the scheduled appointment time.

6. Prohibited Uses

You may not use our service:

• In any way that violates any applicable national or international law or regulation

• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent

• To impersonate or attempt to impersonate emHealth, a emHealth employee, another user, or any other person or entity

• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful.

  This is illusory and not exhaustive.

7. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of emHealth and its licensors. The service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Limitation of Liability

In no event shall emHealth, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

9. Indemnification

You agree to defend, indemnify, and hold harmless emHealth and its limited user licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

10. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the service.

11. Governing Law

These Terms shall be interpreted and governed by the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we shall display the same in our website and your continuous usage would indicate your acceptance for the same.

What constitutes a material change will be determined at our sole discretion.
